CONGOLESE fuel supplier Orion Energy SARL, which had applied for a default judgment against Eco Fuel Investment, has withdrawn its legal action against the entity owned by fugitive businessman Victor Simaneka Malima.
Orion had lodged a case accusing Malima and Eco Fuel of failing to deliver fuel despite receiving advance payment. The company further alleged that in 2021 it paid more than USD 1.3 million (N$25.35 million) for ULP 95 petrol and diesel, but large quantities were never supplied. Orion therefore sought a default judgment, claiming N$5.5 million from Eco Fuel.
Felicity Gaes, the lawyer representing Orion, did not respond to queries regarding the withdrawal of the matter.
While most of his co-accused have been languishing in prison since their arrests in July 2025, Malima has evaded the long arm of the law, allegedly fleeing to Angola after learning that individuals linked to transactions conducted by his company had been arrested in connection with the National Petroleum Corporation of Namibia’s (Namcor) fraud and corruption case. In that matter, more than N$400 million was allegedly siphoned from the state oil entity through asset deals and credit fraud.
